Which matrimonial property system applies to your marriage?

Your matrimonial property system affects the starting point for financial analysis. Obtain the marriage certificate, antenuptial contract and any later court order or notarial contract changing the system. The way a couple informally describes their finances may not match the legal position.

Find the governing documents

For marriages governed by the relevant South African civil framework, distinctions include community of property and marriages out of community of property, with or without accrual. The marriage date, legal form, contract and any cross-border factors may be important. Customary marriages and other circumstances require their own assessment.

Separate assumptions from evidence

Do not assume that maintaining separate bank accounts proves that a marriage is out of community of property. Equally, do not assume that an antenuptial contract necessarily excludes accrual. Read the complete document and identify excluded assets, commencement values and any special provisions.

Prepare an asset-and-liability schedule showing ownership, values, supporting documents and disputed classifications. Label estimates. A property registered in one name, a family business or a pension interest may need legal analysis beyond the name appearing on a statement.

Check any proposed change

Changing a property system during marriage is a legal process. Section 21 of the Matrimonial Property Act addresses a joint court application in the circumstances it covers, including reasons, creditor notice and prejudice considerations. Signing a private replacement arrangement does not necessarily achieve the intended change.

If the regime is uncertain, obtain advice before relying on an accrual or division calculation. Financial worksheets help organise information once the assumptions are understood; they cannot select a legal regime for you.

Use a document checklist before a division calculation

Two couples may both keep separate bank accounts but have different matrimonial property systems. One may have a registered antenuptial contract with accrual and the other may have a different legal starting point. The banking arrangement alone does not answer the question. Locate the complete contract and any later court order before entering a financial model.

Create a short document index showing the marriage certificate, contract, amendments or orders, and the date and place of marriage. If a document is missing, ask how to obtain an appropriate copy. Where another country is involved, record the relevant residence and domicile history for advice. Do not choose the apparently most favourable regime in a calculator while that issue is unresolved.
