Unpaid maintenance: organise the evidence before enforcement

Start with the complete maintenance order or enforceable agreement and every later variation. An arrears calculation is only as reliable as the obligations and payments entered. Keep the document wording available beside your payment schedule.

Start with the obligation

Create one row for each instalment period. Record the amount due under the applicable order, any valid escalation or variation, the payments allocated to that period and the supporting bank reference. Show disputed allocations separately. Do not silently treat a gift or an unrelated payment as maintenance, or ignore a payment that may need credit.

Reconcile the evidence

Reconcile the ledger with bank statements and receipts. If the order includes direct school or medical payments, keep those obligations identifiable. A general cash total can hide whether a specific ordered expense was paid. Record missing evidence as a question requiring resolution.

The principal balance is the total properly due less properly credited payments. A basic payment ledger does not automatically add interest, collection costs or inflation. Those items require their own legal basis and supporting calculation. A positive ledger total does not by itself prove enforceability, and an old entry does not by itself establish prescription.

Prepare for enforcement advice

Take the order, variations, reconciliation and evidence to the appropriate adviser or maintenance office. Ask which enforcement route fits the facts and what additional documents are required. Keep a record of subsequent payments so the claimed amount remains accurate.

Do not use a maintenance dispute as a reason to obstruct contact. If there is an immediate safety concern or a separate parenting dispute, obtain advice on that issue directly.

Separate the principal shortfall from other claims

Suppose an order requires R4 000 each month for January, February and March, with no escalation in that period. If properly credited payments total R9 000, the starting principal shortfall is R3 000 against R12 000 due. Record the individual payment dates and references so that this total can be checked. Keep any disputed payment allocation visible.

Do not add interest, penalties, collection fees or additional school expenses simply because a spreadsheet permits another row. Each claimed item needs its own basis in the order and applicable law. The Department of Justice provides separate maintenance enforcement and non-compliance forms. Ask the maintenance office or attorney which process and documents fit the circumstances.

Questions to take to a consultation

1. Do you have the complete order and every relevant variation?

2. Are the due dates, escalation and direct-payment terms recorded correctly?

3. Can each payment or alleged missing payment be traced to evidence?

4. Which parts of the total are disputed or need a separate legal calculation?

5. Which enforcement route is appropriate, and who will take the next step?
